These Terms and Conditions govern your use of Azure Bay Yachting's website and services. By accessing our website or making a booking, you agree to be bound by these Terms and Conditions.
Important: These terms contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you. Please read them carefully.
1. Booking and Reservations
1.1 All bookings are subject to availability and confirmation by Azure Bay Yachting.
1.2 To secure a booking, a deposit of 30% of the total charter fee is required unless otherwise specified.
1.3 The balance of the charter fee must be paid at least 14 days before the charter date.
1.4 Bookings made within 14 days of the charter date require full payment at the time of booking.
2. Cancellation and Refund Policy
2.1 Cancellations made more than 30 days before the charter date will receive a full refund of the deposit.
2.2 Cancellations made between 14 and 30 days before the charter date will receive a 50% refund of the deposit.
2.3 Cancellations made less than 14 days before the charter date will not be eligible for a refund.
2.4 In the event of cancellation by Azure Bay Yachting due to unforeseen circumstances, a full refund will be provided or alternative dates offered.
3. Charter Conditions
3.1 The charter period begins and ends at the times specified in your booking confirmation.
3.2 The captain has absolute discretion regarding sailing conditions and may alter or cancel the charter for safety reasons.
3.3 All charters are subject to weather conditions. If the captain determines conditions are unsafe, the charter may be rescheduled or refunded.
3.4 The charter route may be modified at the captain's discretion based on weather conditions and safety considerations.
4. Passenger Responsibilities
4.1 Passengers must follow the captain's and crew's instructions at all times.
4.2 Passengers are responsible for their own safety while onboard and during water activities.
4.3 Children under 12 must wear life jackets at all times while on deck.
4.4 Passengers must disclose any medical conditions that may affect their participation in the charter.
4.5 Passengers are liable for any damage to the yacht or equipment caused by negligence or willful misconduct.
5. Safety and Conduct
5.1 No illegal substances are permitted onboard.
5.2 Smoking is only permitted in designated areas.
5.3 The captain reserves the right to terminate the charter immediately if passengers engage in dangerous, illegal, or disruptive behavior without entitlement to a refund.
5.4 All passengers must comply with maritime laws and regulations.
6. Liability
6.1 Azure Bay Yachting maintains comprehensive insurance for all vessels and operations.
6.2 Azure Bay Yachting shall not be liable for any loss, damage, injury, or delay caused by circumstances beyond our reasonable control.
6.3 Passengers are advised to obtain their own travel insurance to cover personal belongings, medical expenses, and trip cancellation.
6.4 The maximum liability of Azure Bay Yachting for any claim shall not exceed the total charter fee paid.
7. Privacy and Data Protection
7.1 We collect and process personal information in accordance with our Privacy Policy.
7.2 By making a booking, you consent to the processing of your personal data as described in our Privacy Policy.
8. Intellectual Property
8.1 All content on our website, including text, graphics, logos, and images, is the property of Azure Bay Yachting and protected by copyright laws.
8.2 You may not reproduce, distribute, or create derivative works from any content without our express written permission.
9. Governing Law
9.1 These Terms and Conditions are governed by and construed in accordance with the laws of Hong Kong SAR.
9.2 Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of Hong Kong SAR.
10. Changes to Terms
10.1 Azure Bay Yachting reserves the right to modify these Terms and Conditions at any time.
10.2 Continued use of our services after changes constitute acceptance of the modified terms.
